Information on processing of your personal data

We hereby inform you that we process your personal data. Details regarding this can be found below.

I. Personal data administrator

We, Lubatex Spółka z ograniczoną odpowiedzialnością (Lubatex Limited Liability Company), with its registered office in Lubawka, ul. Mickiewicza 17, 58-420 Lubawka, are the Administrator of your personal data.

II. Data Protection Officer

We have appointed a Data Protection Officer, with whom you can contact regarding the protection of your personal data and the exercise of your rights through the contact form on the website www.lubatex.pl; e-mail: iod@lubatex.pl; or in writing to the address of our registered office indicated in point I

III. Purposes and legal bases for processing

For the purpose of:

1) presenting an offer and answering questions asked by you via the contact form placed on our website based on your consent (basis from art. 6 sec. 1 lit. a GDPR)

2) concluding a sales contract for our products based on your interest in our offer (basis from art. 6 sec. 1 lit. b GDPR)

3) performance based on the sales contract concluded by you with us, (basis from art. 6 sec. 1 lit. b GDPR);

4) archival (evidentiary) purposes to secure information in case of a legal need to demonstrate facts, which is our legitimate interest (basis from art. 6 sec. 1 lit. f GDPR);

5) potential determination, assertion or defense against claims, which is our legitimate interest (basis from art. 6 sec. 1 lit. f GDPR);

IV. Categories of your data that we process

We will process the following categories of your data:

• first and last name
• home address or company registered address
• telephone number
• e-mail
• order number

V. Data recipients

Your personal data may be made available to the following categories of entities:

– subcontractors, i.e. entities we use in their processing, i.e. accounting, legal, IT companies, claims adjusters, marketing agencies

VI. Transfer of data to third countries or international organizations

We do not transfer your data outside Poland/UE/European Economic Area.

VII. Data retention period

1. Your data obtained for the purpose of concluding a sales contract we store for the period of contract negotiations and until the end of the calendar year following the year in which you last contacted us regarding its conclusion.

2. Your data obtained in connection with the conclusion of a sales contract we process until the end of the limitation period for potential claims from the contract

3. Your basic contact data we store for direct marketing purposes of our products and services until you object to their processing for this purpose, withdraw consent, if we processed them on the basis of so-called marketing consent, or we determine that they have become outdated.

VIII. Your rights:

You are entitled to:

a) the right to access your data and receive a copy of it

b) the right to rectification (correction) of your data

c) the right to erasure of data. If in your opinion there is no basis for us to process your data, you can request that we delete it.

d) restriction of data processing. You can request that we limit the processing of your personal data only to their storage or performance of actions agreed with you, if in your opinion we have incorrect data about you or process it without basis; or you do not want us to delete it because you need it to determine, assert or defend claims; or for the time of objection to data processing submitted by you.

e) the right to object to data processing,

f) the right to data portability: You have the right to receive from us in a structured, commonly used format suitable for machine reading (e.g. “.csv” format) the personal data concerning you that you provided to us on the basis of a contract or your consent. You can also instruct us to send these data directly to another entity

g) the right to lodge a complaint with a supervisory authority If you believe that we process your data unlawfully, you can file a complaint in this matter with the President of the Office for Personal Data Protection or another competent supervisory authority

h) the right to withdraw consent to the processing of personal data At any time you have the right to withdraw consent to the processing of those personal data that we process on the basis of your consent. Withdrawal of consent will not affect the lawfulness of processing carried out on the basis of your consent before its withdrawal.
